InintroducingthecontentsoftheMarinefisheriesecolabellingguidelines,theSecretariatprovided backgroundinformationontheconsiderationsthathaveguidedthenegotiationsinthedevelopmentof theseguidelinesandidentifiedareasthatwerelikelytorequirespecialattentionbytheexperts including,interalia,theneedtodefineinlandfisheries. TheExpertConsultationproceededtomodifytheMarineCaptureFisheriesEcolabellingGuidelines' tomakethemapplicabletoinlandcapturefisheries.TheproposedGuidelinesfortheEcolabellingof FishandFisheryProductsfromInlandCaptureFisheriesareshowninAppendixE. DEFINITIONOFINLANDCAPTUREFISHERIESFORTHEPURPOSEOF ECOLABELLING Inrecognitionofthefactthatasignificantportionofproductionfrominlandwatersisderivedfrom culture-basedandenhancedfisheries,theExpertConsultationincludedthesefisherieswithinthe definitionofinlandcapturefisheries.Ecolabellingofthesefisherieswouldhelpprotectaquatic biodiversityandpromotemarketaccesstoinlandcapturefisheryproducts. SCOPE,PRINCIPLES,GENERALCONSIDERATIONS,ANDMINIMUMSUBSTANTIVE REQUIREMENTSANDCRITERIAFORTHEECOLABELLINGOFFISHANDFISHERY PRODUCTSFROMINLANDCAPTUREFISHERIES Scope Whiletheguidelinesforinlandcapturefisheriesincludeanumberofaspectsofusingculturedfish, theirscopeisnotintendedtorepresentguidelinesforecolabellingfishandfisheryproductsfrom aquaculture. Principles Paragraph2.1containsreferencestothe1982UnitedNationsConventionontheLawoftheSea(the 1982Convention),andthe1995AgreementfortheImplementationoftheProvisionsoftheUnited NMaatniaognesmCeonntveonftiStornadodnlitnhgeFLisahwSotofctkhseaSnedaHoifgh1l0yDMeigcreamtboerryF1i9s8h2Srteolcaktsing(thtoet1h9e95CoUnsNerFviasthioSntoacnkds Agreement).Theseinternationalinstrumentsdonotapplytoinlandwaterbodies,however,they containprovisionsofrelevanceforthemanagementofinlandcapturefisheries.Therefore,referenceto theseinstrumentswasretainedinparagraph2.Ibis. tPoarianglraanpdhc2a.p1tuwraesfmisohdeirfieise,dntaomceolnytaitnheex1p9li9c5itFrAefOerCenocdeetoofinCteornndauticotnaflorinRsetsrpuomennstisbldeireFcisthleyrrieesl,evatnhte 1993ConventiononBiodiversityandthe1971(2005)RamsarConvention. Generalconsiderations Paragraph5wasmodifiedbecause,slrictusensus,RegionalFisheriesManagementOrganizations (FiRsFheMrOises)OdroganneitzaetxiisotnfaonrdintlhaendMceakpotunrgeRfiisvheerrieCso.mImtiwsassionnotweedrtehatn,otfoRrFinMsOtasnceb,utthreegLiaoknealVifcitsohreiray bodies.Therefore,theExpertConsultationagreedtoadoptthroughoutthetextoftheguidelinesthe widertermofregionalfisherybody(RFB)whichappliedtobothRFMOsaswellastobodieshaving purelyadvisoryfunctions(paragraphs5and27). Minimumsubstantiverequirementsandcriteria TheExpertConsultationagreedonanumberofamendmentsinthesectionsaddressingmanagement systems, “stocksunderconsideration”,ecosystemconsiderationsandmethodologicalaspectsbecause inlandcapturefisheriesofteninvolveenhancementandculture-basedinterventions(paragraphs28- 32). Copyrightedmaterial 2 3 Enhancedfisheriesmayinvolveanumberoftechniques,someofwhicharepermanentornearlyso, e.g.speciesintroductionsandhabitatmodification,andsomeofwhichcouldbetemporary.Insome cases,thesustainabilityofthetargetspeciescoulddependonthemaintenanceoftheenhancements. However,theharvestofthetargetspeciesinenhancedfisherieswouldstillbemanagedtoconserve naturalproductioncomponentsofthe“stockunderconsideration”andtominimizeadverseimpactson theecosystem,e.g.protectbiodiversityofaquaticecosystemsandhabitats,minimizebycatchand discards,andusenon-destructivefishingmethods(seeparagraphs29-31). Inthespecialcaseofculture-basedfisheries,wherethefisheryissolelymaintainedbystockingfrom aquaculturefacilities,sustainabilityofthetargetspecieswouldnotbethefocusofanecolabelling programme. Thesustainabilityoftheculture-basedfisherywouldrelateprimarilytotheoptimal productionoftheculturedfishinthenaturalecosystemandtoensurethisproductionismanagedina mannertoconservebiodiversityandecosystemfunctions. Unitofcertification(paragraph251:Thelastsentenceofthisdefinitionhadasignificantbearingon theExpertConsultation'sconclusionthatgeographicboundariesofinlandfisheriesdidnotneedtobe defined.Asfishstockscontributingtoriver,lakeandreservoirfisheriesmayalso,insomecases,be caughtinestuarineandmarineareas,theconsiderationofimpactsofallfisheriesutilizingastockor stocksacrosstheirentireareaofdistribution,includingalllifestages,isanimportantelementof assessingthestateofthe"stockunderconsideration”. ExpertConsultationfeltthevalidityofboth“bestscientificevidence”andtraditionalknowledge shouldbeobjectivelyvalidated(paragraphs2.10,29.2,29.3).TheExpertConsultation,furthermore, consideredthatthismayalsobegenerallyapplicabletomarinecapturefisheriesand,therefore, recommendedthisamendmenttobedoneinthemarinecapturefisheriesecolabellingguidelines (showninsquarebracketsinAppendixE). Fitnessforsurvival(paragraph30bhThequalityofstockingmaterialforenhancedorculture-based fisheriesfundamentallyrelatestotraitsnecessaryforsurvivalinthewildunderdifferentand sometimesharshenvironmentalconditions,butnottotraitsrelevanttoaquaculture(e.g.fastgrowth andlateageatmaturity).Forthesereasons,rearingconditionsforculture-basedstockingmaterial shoulddifferfromthoseforaquacultureandincludetimelyacclimatizationtotheenvironmental conditionsprevalentinthewild. Forclarityintheinterpretationoftheminimumsubstantiverequirementsandcriteria,theExpert ConsultationagreedtoincludethefollowingdefinitionsforStocking,Introducedspecies(alien species),andTranslocations(transfers)intothesectiononTermsanddefinitions(paragraphs2Id, 23b,24b).
